1. General Provisions
These Terms of Service (“Terms”) govern your use of the Elvaro website and related services. By using the site you accept these Terms. If you do not agree, please do not use our services.
2. Services
Elvaro provides:
- Online shop for tools and equipment (sale and rental).
- VIP Club — membership programme with extended rental privileges.
- Elvaro Go — courier delivery to parcel terminals.
3. Account Registration
You agree to provide accurate information when registering. You are responsible for keeping your account credentials secure. Notify us immediately of any unauthorised access at support@elvaro.lv.
For booking/rental and subscription orders, a customer account is created automatically using your billing email so you can track orders and access signed agreements.
4. Orders and Payment
An order is accepted upon receipt of an email confirmation. Prices are stated in euros (€) inclusive of VAT. Payment is processed via Every Pay payment gateway. We reserve the right to refuse or cancel an order for legitimate reasons (stock unavailability, suspected fraud, etc.), in which case any charge is refunded in full.
5. VIP Club Membership
The VIP Club subscription costs €47.88/year (€3.99/month equivalent), billed annually as a single payment. Membership provides access to equipment rental, member discounts, and exclusive products.
Active rental limit: 5 concurrent items, up to €300 combined value. Refunds for unused membership periods are at the discretion of Elvaro administration.
6. Equipment Rental
Rental is available to active VIP Club members only. Minimum rental period is 1 day. Equipment must be returned in the same condition as received. The tenant is liable for any damage in accordance with the signed Rental Agreement.
Late returns are subject to additional charges at the daily rental rate. Elvaro reserves the right to charge the card on file for unreturned or damaged equipment.
7. Electronic Agreement Signing
Rental and subscription agreements are signed electronically using a one-time code (OTP) delivered to your email or phone. By entering the OTP you confirm you have read and accept the agreement terms.
The signed PDF, together with technical signing data (IP, User-Agent, timestamp, OTP hash), constitutes a Simple Electronic Signature under Regulation (EU) No 910/2014 (eIDAS) and is legally binding under Latvian law. A copy is emailed to you immediately after signing.
8. Pavadziņme (Delivery Note)
A pavadziņme is issued automatically upon successful payment and emailed to your billing address. It serves as your proof of purchase / delivery document.
9. Returns and Refunds
Products purchased (not rented) may be returned within 14 days of receipt in original, unused condition in accordance with EU consumer protection law. Contact support@elvaro.lv to initiate a return.
10. Limitation of Liability
Elvaro is not liable for indirect losses, including lost profits, arising from the use or inability to use our services, except as required by applicable law.
11. Changes to Terms
We may update these Terms and will notify registered users by email at least 14 days before changes take effect. Continued use of the service after that date constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of Latvia. Disputes are resolved in the courts of Latvia. Consumer disputes may also be submitted to the Consumer Rights Protection Centre (ptac.gov.lv).
